Statutory rates and compensation update - 2010

Yvette Cooper, the Secretary of State for Work and Pensions, has recently announced the proposed rates of many of the statutory payments that change in April 2010.

  • The earnings threshold for statutory adoption, maternity, paternity     and sick pay would rise from £95.00 to £97.00 per week.
  • Statutory adoption, maternity and paternity pay and maternity allowance would rise from £123.06 to £124.88.
  • Statutory sick pay to remain at £79.15.

For the first time ever, the annual review of compensation limits has resulted in a reduction to the maximum compensatory award limit due to the decrease of 1.4% in the Retail Prices Index from September 2008 to September 2009. Where the event giving rise to the entitlement to compensation or other payment occurs on or after the 1st February 2010 : -

  • The maximum compensatory award at tribunal drops from £66,200 to  £65,300.
  • The maximum guarantee payment in cases of layoff and short time working reduces from £21.50 to £21.20.
  • The minimum compensation where an individual is unlawfully excluded or expelled from a union drops from £7,300 to £7,200.
  • A week's pay (for basic award and redundancy pay purposes) remains the same at £380.

Regular readers will note that the limit on a week’s pay used to calculate redundancy payments and the unfair dismissal basic award remains the same this year. This is usually linked to the same RPI formula as the other limits but was suspended following a one-off increase in October last year. This limit will remain at £380 until February 2011 at the earliest.
